By accepting our quote you accept the terms and conditions.
We can only accept your equine for transport if you have your equine's passport to hand
Parties:
The parties to this agreement are: On Point Equine Transport (The CARRIER);
The person or entity named as the customer on the transport certificate (The CUSTOMER)
Definitions and Interpretation:
The expression 'The EQUINE' means the horse, pony, gelding, mare or stallion specified on the transport certificate.
The expressions 'The COLLECTION ADDRESS' and 'The DELIVERY ADDRESS' mean respectively the addresses so specified on the transport certificate or if notified in reasonable time by the CUSTOMER to another location as stipulated.
Carrier's Obligation:
The CARRIER will carry the EQUINE from the COLLECTION ADDRESS to the DELIVERY ADDRESS on the date specified on the transport certificate. The vehicle shall be duly taxed and insured, it shall be in a roadworthy condition and shall be suitably equipped for the safe and convenient carriage of the EQUINE. It is the CUSTOMER'S responsibility to ensure the vehicle is of a suitable specification for the EQUINE.
Risk:
The EQUINE and all belongings shall be carried at the CUSTOMER'S risk in all respects and the CARRIER shall not be liable for any of the following whether by reason of the CARRIER'S negligence or otherwise. Injury or damage to the EQUINE while in the custody or control of the CARRIER. Delay in delivery of the EQUINE or failure to follow any instruction or direction of the CUSTOMER.
CUSTOMERS travel in the horsebox at their own risk
Insurance:
It is always the responsibility of the CUSTOMER to maintain a policy of insurance in respect of injury to or death of the EQUINE for the duration of the transportation being undertaken by the CARRIER.
The CUSTOMER is liable to cover the cost of repairs to any damage caused by the EQUINE. The CUSTOMER can inspect the vehicle before loading and agree prior condition with the CARRIER as discussion will not be entered into subsequently. CUSTOMERS and their belongings travel at their own risk.
Please ensure the EQUINE has a passport, and hand it over to the CARRIER upon arrival. Failure to provide the passport will result in abandonment of the trip and no refund will be given.
Route:
The CARRIER may carry the EQUINE by any route and may alter the route at the CARRIER'S discretion.
Delivery:
The CARRIER'S obligations in relation to delivery are as follows: To deliver the EQUINE to the DELIVERY ADDRESS or if notified in reasonable time to another location as stipulated by the CUSTOMER.
Where another DELIVERY ADDRESS is necessary or specified by the CUSTOMER, the CUSTOMER accepts and agrees to pay all additional costs and expenses.
Should the EQUINE become unwell or unsettled during transport and in the opinion of the CARRIER it is deemed necessary to call a vet the CUSTOMER will be liable for all expenses incurred.
The EQUINE will be transported in the manner it is presented to the CARRIER. I.E with or without travel boots, bandages, rugs,
The CARRIER shall not be liable for any late deliveries due to either road or loading conditions.
Cancellation/Abandonment:
The CUSTOMER warrants that each EQUINE has been properly described and does load and travel without concern. 30 minutes loading time is allowed within the standard call-out charge. Should the EQUINE take longer than 30 minutes to load, an additional charge of £15 per 30 minutes will be levied. Abandonment of the journey is entirely at the CARRIER'S discretion. The CARRIER reserves the right to return the EQUINE back to the CUSTOMER should it display dangerous or damaging behaviour to either itself or the horsebox and the CUSTOMER will NOT be entitled to a refund.
Should the customer wish to cancel the transport after only the DEPOSIT has been payed the CARRIER reserves the right to move the transport to another date suitable for both parties. No refunds will be offered.
Should the CUSTOMER wish to cancel the transport within 48 hours of the booked date the CUSTOMER will be entitled to a refund of 50% of the agreed price (if payed in full). Should the CUSTOMER wish to cancel the transport within 24 hours of the booked date the CUSTOMER will NOT be entitled to any refund.
Should the CUSTOMER fail to provide the EQUINES passport(s) upon loading then the CARRIER will wait for no longer than half an hour in order for the CUSTOMER to produce the passport(s). Should the customer be unable to produce the passport(s) after this time then the CARRIER reserves the right to abandon the transport and will if possible rebook when the passport(s) are available. Extra charges will apply. No refunds will be given.
Payments:
Unless otherwise agreed in writing, payment is due, in full BEFORE COLLECTION of the EQUINE.
Your transport booking will NOT be confirmed until either the deposit or the full amount has been paid at which point your date is booked
If the balance of payment (where a deposit has been taken) has not been paid the night before transport the CARRIER reserves the right to cancel the booking. No refunds will be offered.
Jurisdiction:
The parties agree that these terms and conditions shall be interpreted and construed in accordance with the laws of England and Wales and shall be subject to the jurisdiction of the English courts.
Please note that On Point Equine Transport always recommend that their CUSTOMERS obtain insurance cover in respect of injury to or death of the EQUINE for the duration of the transportation.
