On Point Equine Transport – Terms & Conditions

These Terms & Conditions apply to all transport services provided by On Point Equine Transport (“the Carrier”). By confirming a booking, the customer (“the Customer”) agrees to the following terms.
1. Definitions
- Carrier: On Point Equine Transport
- Customer: The individual or organisation booking the transport
- Equine: The horse, pony, mare, gelding, or stallion being transported
- Transport Certificate: The booking confirmation issued by the Carrier
2. Customer Responsibilities
- The Customer must provide the Equine’s passport at the time of collection.
- The Customer must ensure the Equine is accurately described and fit to load, travel, and unload.
- The Customer is responsible for ensuring the Equine has appropriate insurance to cover injury, illness, or loss during transport.
- The Customer must disclose any relevant behavioural, medical, or handling information before transport.
- The Customer must ensure safe access for loading and unloading at both the Collection and Delivery Addresses.
3. Carrier Responsibilities
- The Carrier will transport the Equine from the agreed Collection Address to the Delivery Address on the confirmed date.
- The vehicle will be fully insured, taxed, roadworthy, and equipped for safe equine transport.
- The Carrier will take reasonable care of the Equine throughout the journey and act in accordance with welfare legislation and best practice.
4. Risk & Liability
- All Equines and belongings are transported at the Customer’s risk.
- The Carrier will take reasonable care during transport but cannot guarantee the safety, health, or condition of the Equine.
- The Carrier is not liable for injury, illness, stress, or death of the Equine during or after transport.
- The Carrier is not liable for delays caused by traffic, weather, loading issues, or unforeseen circumstances.
- The Carrier is not liable for damage caused by the Equine to the vehicle, equipment, or property.
- The Customer is responsible for ensuring the Equine is adequately insured for transport.
5. Emergency Control Authority
To protect the Equine’s welfare and ensure public safety:
- The Carrier may make immediate decisions in emergency situations, including contacting a veterinarian, adjusting or stopping the journey, diverting to a safe location, or returning the Equine to the Collection Address.
- The Carrier will make reasonable efforts to contact the Customer before taking action.
- If the Customer cannot be reached, the Carrier may act in the best interests of the Equine’s welfare.
- All costs arising from emergency actions (veterinary fees, stabling, additional mileage, etc.) are the responsibility of the Customer.
6. Veterinary Intervention
- If the Equine becomes unwell, distressed, or unsafe during transport, the Carrier may seek veterinary assistance.
- The Customer is responsible for all associated costs.
7. Loading, Behaviour & Abandonment
- The Customer warrants that the Equine loads safely and travels without undue stress.
- The Equine will be transported in the condition and equipment provided by the Customer (e.g., boots, rugs, bandages).
- 30 minutes of loading time is included. Additional time is charged at £15 per 30 minutes.
- If the Equine displays dangerous or unmanageable behaviour, the Carrier may refuse to load, abandon the journey, or retain payment in full.
- If the Equine cannot be transported due to behaviour, the Customer remains responsible for all costs incurred.
8. Weather & Safety Adjustments
- The Carrier may reschedule transport if weather conditions make travel unsafe.
- A revised date/time will be offered.
- If the Customer declines the revised date:
- More than 48 hours before transport: 50% refund
- Less than 24 hours before transport: No refund
9. Cancellations & Refunds
- Deposit-only bookings: May be moved to another mutually agreed date. No refunds.
- Customer cancellations:
- More than 48 hours before transport: 50% refund
- Less than 24 hours before transport: No refund
- If the Customer fails to provide the Equine’s passport within 30 minutes of arrival, the Carrier may abandon the journey with no refund.
10. Payments
- A non-refundable deposit may be required at the time of booking, as specified by the Carrier.
- Payment must be made in full before collection, unless otherwise agreed in writing.
- Bookings are not confirmed until the deposit or full payment is received and acknowledged by the Carrier.
